Terms of Service

Updated 7 October 2026. These terms govern use of PV8, which is provided by Sator Energy EOOD (“PV8”), identified in section 15. An order form, enterprise agreement or data-processing agreement agreed with you takes priority where it says so.

1. Service and eligibility

PV8 is a decision-support workspace for operating and prospective photovoltaic assets. It provides deterministic screening engines, evidence workflows, reports, engineering exports, collaboration and optional AI-assisted features. You must be authorised to act for the assets you place in the service and for any organisation you represent.

Depending on your plan and the evidence available, the workspace supports asset profiles, repowering, storage, wind, data centres, EV charging, direct-wire supply, hydrogen, agrivoltaics, irrigation, land-use and recycling assessments, together with financial models and decision documents such as IC papers, lender packs and decision packs for boards and banks. Availability varies by engine, country, data source and account permissions; a menu item or illustrative example is not a promise that every assessment or export is available for every site.

2. Accounts, trials and subscriptions

The trial offer shown when you register and at checkout determines when access starts, whether a card is required, the allowances and whether the trial converts to a paid subscription. Registration alone does not start a card-required trial.

The current card-required offer is a seven-day trial of the Basic plan. It starts when you add a payment card in Stripe Checkout, either when you register or, where the offer says so, after your first result when you choose to keep the workspace. Unless you cancel before the trial ends or change your subscription through billing, it continues as a paid Basic subscription at the price and billing interval confirmed at checkout, and Stripe charges your card when the seven days end. Choosing another plan as an initial preference does not make the free trial a trial of that plan.

Before a card is added, the workspace shows what is available. Where the card follows your first result, you can work on one asset within Basic limits, downloads are marked as previews, and sharing, requests for information, a second asset and some exports wait until you keep the workspace. Each workspace can have one free trial; a workspace that has already had a trial or a subscription is charged from the start of a new subscription.

If you were offered a trial without a card, it does not automatically convert to a paid subscription; its displayed module and report allowances apply. Existing trial promises are not changed merely because the offer for new registrations changes.

Basic and Standard can be bought online with monthly or annual billing; Portfolio and Enterprise are agreed individually. Prices are shown in euros; prices for businesses are shown excluding VAT. VAT is added at checkout where applicable: consumers pay the VAT that applies to them, and EU businesses with a valid VAT number may be invoiced under the reverse charge where applicable. Plan limits cover assets, aggregate capacity and seats as displayed for your subscription. Unfinished creation drafts and PV8’s representative demonstration asset do not count towards the asset limit. Paid access and changes depend on billing confirmation, verified e-mail and the required account role.

PV8 Concierge and specialist AI features are optional and subject to the availability, permissions, allowances and any separate price shown for the action or agreed in your order. Access to a deterministic engine does not by itself promise unlimited AI use.

3. Your data and owner control

You retain rights in asset records, files, outputs, comments and evidence you or your reviewers provide (“Owner Data”). You grant PV8 the limited rights needed to host, secure, process and present Owner Data for your workspace and to provide support you request.

Owner Data is not contributed to cross-customer aggregate benchmarks. PV8 may improve the general service using public, licensed, synthetic and operational data that does not contain Owner Data.

You are responsible for having the right to upload materials and for reviewing extracted facts and assumptions before relying on an output.

3a. Processing personal data for you

For personal data of other people in material you place in your workspace or receive through PV8, such as people named in your documents and counterparties’ representatives and contact persons, you are the controller and PV8 processes that data on your behalf as your processor. A data-processing agreement agreed with you takes priority.

4. Demonstration assumptions

PV8 may offer a representative demo so a first-time user can reach an illustrative output. Demo records and their reports are visibly marked. They are not facts about your asset, owner evidence or a substitute for completing your asset profile.

The public site screen, interactive How it works examples and sample downloads are illustrative screening materials, not a site survey, a verified investment case or an offer from a landowner, supplier or electricity customer. Completing a sample journey does not establish facts about your own plant.

4a. AI agents and AI-assisted processing

Ask PV8 / Concierge explains results and may propose scenario inputs. Applying a proposal fills draft assumptions only; it does not verify a fact, update accepted asset evidence or constitute a completed calculation. Running an engine, saving a result, exporting or sending a request are separate actions subject to the relevant confirmation and permissions. Specialist agents may extract evidence or draft materials for review; AI output can be incomplete or incorrect, including its citations.

Concierge chat, where enabled for your organisation, uses OpenAI. Submitting the chat instructs PV8 to send the conversation and the displayed asset context and engine summary needed for that task; it does not automatically send your document files. Decision-intelligence actions also use OpenAI and send text from the asset’s documents (up to 20 excerpts), or the results or bids you select. Specialist agents, meeting-minutes structuring and translation of the workspace and reports use Anthropic and may process the documents or text selected for that action or shown in the language you choose; a link holder’s download of a shared report uses stored or cached translations and never triggers a new AI call. Reviewed public-page translations are served from static catalogues.

Where your workspace is in PV8’s AI preview, answers to questions about a result, values proposed from documents you upload, investment-memo commentary and drafted requests for missing facts also use Anthropic. A value proposed from a document, or a counterparty’s answer to such a request, enters your model only when you approve it.

Anthropic and OpenAI act as PV8’s processors under their business API terms, which state that API inputs and outputs are not used for model training by default. PV8 switches off provider-side storage where the provider’s API offers that setting, but this is not a promise of zero retention. Submit only material you are authorised to share with these providers. See the Privacy Notice for what each provider receives, retention and contact information. AI output can be incomplete or inaccurate. It is screening support, not advice: it does not replace PV8’s deterministic calculations or your review of evidence, and you remain responsible for decisions based on it.

5. Sharing, experts and counterparty requests

Read-only links, collaborative-run links and expert access default to seven days unless the asset owner chooses another duration between 1 and 365 days while sharing. The owner controls scope and can revoke access. Anyone with an unexpired link may view the owner-approved frozen report or completed collaborative run without an account, so share it only with intended recipients. A recipient must verify control of an e-mail address before changing assumptions, recalculating or commenting. This purpose-limited verification does not create an account and does not provide access to the owner’s Asset Profile or other engines. An account is required to retain shared work in a workspace, expand it into other engines or originate a new asset.

Experts may comment and submit evidence within their permitted scope; the owner decides whether proposed evidence or changes are accepted. An owner may send a purpose-limited request for information to a counterparty. The secure response link expires after seven days by default. A recipient may submit information only when authorised to do so, and may decline further requests through PV8 for every PV8 workspace. Submitted material remains pending in the owner’s workspace and does not change an asset or output unless the owner accepts it.

Before sharing or publishing, review the selected content, recipient permissions and expiry. An unlisted URL is not password protection. Comments added through a link are visible to the owner’s team and to everyone holding that link. Revoking a link prevents further access through that link but cannot recall files, screenshots or copies already obtained by recipients. E-mail verification establishes control of an address, not the recipient’s professional qualifications or authority to bind a counterparty.

6. Outputs and professional judgment

PV8 outputs are screening and decision-support materials. Their maturity depends on the evidence shown in the output. They do not replace site surveys, detailed engineering, grid offers, permits, legal advice, tax advice, investment advice or approvals by competent professionals and authorities. You remain responsible for decisions and external submissions.

IC papers, lender packs, decision packs for boards and banks, financial models and other PV8 reports are prepared by PV8.ai from the assumptions and evidence they state. They are screening documents, not investment advice, a credit or bankability opinion, a valuation or an offer, and they do not promise any return. An IC paper is structured with AI and leaves the decision to your committee.

When the owner accepts a submitted profile, evidence item or proposed assumption for recalculation, PV8 records a new run and its source. Existing frozen Saved outputs and share-link snapshots are not overwritten; a review based on a Saved output can create a new derived version while retaining the original.

Scenario assumptions are distinct from accepted asset facts. Editing inputs or moving equipment does not update a previous financial result; calculate again and check the run status, inputs, date and evidence before saving or sharing. A failed or incomplete calculation is not a new result, even if an earlier result remains visible. Saved scenarios and exported files describe the version and assumptions they contain, not a continuously refreshed assessment.

Maps, imported CAD/KML geometry, layouts, isometric views, shadows and conflict overlays are decision aids, not construction documents or certified electrical, structural or safety designs. A location or boundary alone does not establish module inventory, string wiring, terrain, ownership or grid import rights. Inferred geometry, wiring and screening clearances require independent verification; an absence of displayed conflicts does not prove the site is conflict-free.

Financial outputs, including NPV, payback, prices and revenues, are conditional on the stated assumptions, currency, dates and evidence. They do not guarantee positive returns, subsidy eligibility, a connection offer, customer demand or financing. Check cost and revenue boundaries, taxes, incentives and separately invoiced electricity before using a scenario commercially.

7. Public and third-party data

PV8 can display public, licensed and third-party information, including grid, market, map and registry context. Source availability, licences and update cycles are outside PV8’s control. PV8 identifies material sources and limitations where they affect an output.

Public records, equipment catalogues and owner-supplied datasheets or power curves may be incomplete, historical, approximate or unverified. Check the source date, coverage and status. A public point, nearby network, mapped facility or indicative capacity does not establish site ownership, usable import capacity, permission to build, an available buyer or a supplier warranty. Third-party attribution and reuse restrictions continue to apply to exports.

8. Acceptable use

You must not misuse the service, bypass access controls, probe for other customers’ information, upload unlawful or malicious material, scrape protected interfaces, resell access without agreement, or use public plant information to imply owner consent or endorsement. PV8 may suspend access needed to protect customers, the service or the law.

9. Intellectual property

PV8 and its licensors own the platform, software, methods, branding and general templates. Subject to payment and these terms, you may use and share your generated outputs for your own purposes or your organisation’s business purposes. Third-party materials remain subject to their applicable terms.

10. Availability and changes

PV8 aims to provide a reliable service and may maintain, improve or replace features. Material subscription changes will be communicated through the service or the account contact. Beta or preview features will be identified where appropriate.

Watch lists, source refreshes, reminders and notifications support review; they are not continuous operational monitoring, emergency alerts or a guarantee that every change or deadline will be detected. PV8 does not operate or control your physical plant. Retain the independent monitoring and professional checks appropriate to your operations.

11. Fees, cancellation and termination

Subscription fees, billing intervals, trial conversion and applicable taxes are shown at checkout or in your order form. Stripe processes card payments and generates subscription invoices. Use Manage billing to open Stripe’s billing portal for card updates, available subscription changes and cancellation, or contact PV8 if that route is unavailable. To avoid the first charge on a card-required trial, cancel before its displayed end time. Cancellation takes effect as shown in the billing confirmation or agreed order; simply ceasing to use the service is not a cancellation instruction. If a payment fails, PV8 e-mails the billing address, and paid access can end if the payment is not completed.

On termination, access ends subject to applicable law and any agreed export period. Export the records you need while your access and permissions allow it; account settings offer a JSON export of your account data, and documents can be downloaded from each asset. Deletion and retention are governed by the Privacy Notice and any applicable data-processing agreement; revocation or deletion cannot retract copies already shared outside PV8. PV8 may terminate for material breach after reasonable notice and an opportunity to cure where appropriate.

11a. Consumer right of withdrawal

If you buy a subscription as a consumer, you may withdraw from the contract within 14 days of the day it is concluded, without giving a reason. Before checkout you are asked to request that the service starts immediately, also for any plan change you later make in Manage billing, and to acknowledge that, if you withdraw within the 14 days, you pay an amount proportionate to the service provided until you told PV8 of your withdrawal, and that you lose the right of withdrawal once the service has been fully provided.

To withdraw, inform PV8 of your decision by a clear statement before the 14 days end, by e-mail to pv8@pv8.ai or by telephone on +420 771 242 881; you may use the model withdrawal form in the annex below, but you do not have to. If you withdraw, PV8 reimburses the payments received from you, less the proportionate amount for the service provided, without undue delay and at the latest within 14 days of receiving your withdrawal, using the same means of payment unless you agree otherwise.

12. Warranties and liability

PV8 will provide the service with reasonable skill and care. To the extent permitted by law, PV8 gives no other warranties, express or implied, including as to merchantability, fitness for a particular purpose or uninterrupted availability.

To the extent permitted by law, PV8 is not liable for indirect or consequential loss, loss of profit or revenue, loss of data beyond restoring it from PV8’s most recent available backup, or decisions taken on the basis of screening outputs. PV8 outputs are screening and decision support, not investment advice, and do not promise any return; you remain responsible for your decisions.

To the extent permitted by law, PV8’s total liability under or in connection with these terms is limited to the fees paid or payable for the service in the twelve months before the event giving rise to the claim.

These exclusions and limits do not apply to liability for intent or gross negligence, for death or personal injury, or to any other liability that cannot be excluded or limited by law. Nothing in these terms limits the statutory rights of consumers.

13. Confidentiality

Each party will protect the other’s confidential information and use it only to perform the agreement. Permitted disclosures include personnel and providers who need the information and are bound to protect it, or disclosure required by law.

14. Governing terms

Bulgarian law governs these terms and any dispute about them. The courts of Sofia, Bulgaria, have exclusive jurisdiction over disputes with business customers. If you are a consumer, you keep the protection of the mandatory laws of your country of residence and may also bring proceedings in the courts there.

If an enterprise agreement exists, it controls. These terms do not remove mandatory rights that apply by law. If you use PV8 as a consumer, nothing in these terms limits the rights you have under applicable consumer law. These terms are written in English; a translation shown on a market edition is provided for convenience only and the English text governs.
